What this covers

These terms apply to genesis98.com. Using the site means you accept them. If you do not, the remedy is not to use it.

They do not govern any work we do for you. Engagements run on a written proposal or agreement signed by both sides, and where that document and this page disagree, that document wins every time.

What is on the site

Descriptions of what we do, and figures describing results. The figures come from Google Analytics and Google Search Console, are rounded down rather than up, and are dated on the page. They describe what happened for specific businesses over a specific window. They are not a prediction and not a promise about what would happen for you. Nobody can honestly make that promise about search or advertising, and we are not going to be the first to try.

Contacting us

The contact form, WhatsApp, text and phone all reach a person. Sending a message does not create a contract, an engagement, or a professional relationship, and it does not oblige us to take the work. It also does not sign you up for marketing messages.

Do not send us through this site:

• Anything confidential you would mind us not being able to protect
• Passwords, account credentials or API keys
• Payment card numbers, bank details, government identifiers or health information
• Anything unlawful, or anyone else’s information you have no right to send

There is a right way to hand over access to an advertising or analytics account, and we will walk you through it. It is never a password in a contact form.

Using the site

Please do not:

• Interfere with the site or the servers behind it, or try to get at anything not deliberately made public
• Scrape it at a rate that degrades it for anyone else, or use automated tools to submit the form
• Impersonate anyone, or misrepresent who you are when contacting us
• Use anything here to build something that competes with it

Who owns what

The text, design, code, logo and name on this site belong to GENESIS 98 LLC and are protected by copyright and trademark law. You may read it, print it, and quote a reasonable amount with attribution and a link. You may not republish it as your own or use our name or mark in a way that suggests we endorse you.

The scripture rendered on the opening screen is quoted from a public domain text.

If you send us an idea or suggestion unprompted, we may use it without owing you anything for it. This is not us trying to take your work. It is how anyone who receives unsolicited ideas has to operate.

Paying for work

The prices published on this site are starting figures. What a piece of work actually costs depends on its size, and we tell you the real number before you commit to anything. Where a signed agreement says something different from this page, the agreement is what applies.

Monthly services are billed in advance, at the start of the period they cover. A one-off build is quoted and scheduled before it starts. Where we manage advertising, our fee is paid in advance and the percentage of managed spend is invoiced at the end of the month, calculated on what was actually spent in that month.

Advertising budget is yours and is paid to the platform, not to us. It is separate from our fee, and we do not mark it up. Anything we buy on your behalf and pass through at cost, such as citation submissions, is invoiced at what it cost us with nothing added.

There is no minimum term. You can stop a monthly service whenever you want to. We ask for notice before the next period begins so that nobody pays for a month they did not intend to start, and we run a short handover so you leave with what is yours.

Invoices are due on the date they state. An invoice that is not paid is a debt and remains payable, and we may pause work while an account is outstanding. If something on an invoice looks wrong, tell us and we will look at it — most of what gets disputed turns out to be a question, and we would rather answer it than argue about it.

Links to other sites

Some links leave this site, including to WhatsApp. We do not control what is on the other end and we are not responsible for it.

Availability

We try to keep the site up and correct. We do not guarantee it will be available, uninterrupted, or free of errors, and we may change or remove anything on it at any time without notice.

Disclaimers and limits

To the fullest extent the law allows, the site is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing on this site is legal, financial, tax or professional advice.

To the fullest extent the law allows, GENESIS 98 LLC is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of your use of this website. Where liability cannot be excluded, it is limited to one hundred US dollars (US$100).

Some states do not allow certain exclusions or limitations. Where that is true, the ones that are not allowed do not apply to you, and the rest stand.

Indemnity

If your use of this site in breach of these terms causes a claim against us, you agree to cover the reasonable cost of dealing with it.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, and the state and federal courts located in Los Angeles County, California have exclusive jurisdiction over any dispute about them. Nothing here takes away a right you have under the consumer protection law of the state you live in.

The rest

If any part of these terms is found unenforceable, the rest continues to apply. Not enforcing something once does not waive it. We may update these terms; the date at the top changes when we do, and continuing to use the site after that means the updated version applies.
